These Terms & Conditions (“Terms”) govern the services provided by Laklin Brooke Photography (“Laklin Brooke Photography,” “we,” “us,” or “our”) to clients (“Client,” “you,” or “your”).
By booking or purchasing photography services from Laklin Brooke Photography, you agree to these Terms together with any photography contract, proposal, invoice, or other written agreement provided to you.
1. Photography Services
Laklin Brooke Photography provides professional photography services in Nashville, Tennessee, and surrounding areas.
Specific services, session details, deliverables, pricing, locations, and other arrangements will be outlined in the applicable client agreement, proposal, invoice, or booking information.
2. Booking and Retainers
A photography session is not considered officially booked until Laklin Brooke Photography has received any required signed agreement and payment or retainer specified at the time of booking.
Unless otherwise stated in a written agreement, retainers are applied toward the total session fee and are non-refundable to the extent permitted by applicable law.
3. Payments
The Client agrees to pay all fees according to the payment schedule provided by Laklin Brooke Photography.
Failure to make a required payment may result in cancellation or postponement of the photography session and may result in the Client being responsible for applicable cancellation fees.
4. Rescheduling and Cancellation
If the Client needs to cancel or reschedule a session, they should contact Laklin Brooke Photography as soon as reasonably possible.
Rescheduling is subject to availability and may be subject to additional fees or the loss of a retainer, as specified in the Client's agreement.
Laklin Brooke Photography reserves the right to cancel or reschedule a session due to illness, emergency, severe weather, unsafe conditions, venue restrictions, equipment failure, or other circumstances beyond our reasonable control.
5. Late Arrival
Clients are responsible for arriving at the agreed location at the scheduled time.
Late arrival may reduce the amount of time available for the photography session and may affect the number of images or services that can be provided.
6. Client Cooperation
The Client agrees to provide accurate information and reasonably cooperate during the photography session.
Laklin Brooke Photography is not responsible for the quality or outcome of photographs affected by circumstances outside our reasonable control, including weather, lighting conditions, venue restrictions, guest cooperation, clothing, hair, makeup, or other factors outside the photographer's control.
7. Artistic Style and Creative Judgment
The Client acknowledges that photography is an artistic service.
Laklin Brooke Photography retains creative and artistic judgment regarding composition, lighting, posing, editing, image selection, and overall photographic style.
The Client acknowledges that the photographer's portfolio represents the general style and quality of work they can expect.
8. Image Selection and Editing
Laklin Brooke Photography may determine which photographs are delivered to the Client unless the applicable agreement specifically provides otherwise.
Photographs are professionally edited according to the photographer's artistic style.
Unedited or RAW files are not included unless specifically agreed to in writing.
Requests for extensive additional editing or retouching may be subject to additional fees.
9. Delivery of Images
Final photographs will be delivered using the method and within the approximate timeframe specified in the Client's agreement.
The Client is responsible for downloading and safely storing delivered photographs.
Laklin Brooke Photography recommends that Clients maintain their own backup copies of delivered photographs.
10. Copyright
Unless otherwise agreed in writing, Laklin Brooke Photography retains the copyright and ownership of the photographs it creates.
The Client receives a personal-use licence to download, print, share, and display delivered photographs for non-commercial purposes, subject to the terms of the applicable agreement.
The Client may not sell, license, materially alter, or commercially exploit the photographs without written permission from Laklin Brooke Photography unless expressly permitted by the Client's agreement.
11. Portfolio and Promotional Use
Laklin Brooke Photography may request permission to use photographs from a Client's session for portfolio, website, social media, advertising, publications, competitions, or other promotional purposes.
Where required, such use will be subject to the Client's consent or other applicable legal basis.
If a separate model or promotional release is provided, its terms will control the permitted use of the photographs.
12. Privacy
Personal information provided by Clients will be handled according to the Laklin Brooke Photography Privacy Policy.
The Privacy Policy forms part of these Terms where applicable.
13. Personal Property
Laklin Brooke Photography is not responsible for loss, theft, or damage to personal property brought to a photography session, except to the extent liability cannot legally be excluded.
14. Force Majeure
Laklin Brooke Photography will not be responsible for failure or delay in performing services caused by circumstances beyond its reasonable control, including severe weather, natural disasters, government restrictions, venue closures, illness, emergencies, transportation disruptions, or other similar events.
In such circumstances, the parties will work together in good faith to reschedule the session where reasonably possible.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Laklin Brooke Photography's liability relating to photography services will be limited to the amount actually paid by the Client for the affected services.
Nothing in these Terms is intended to exclude liability that cannot legally be excluded or limited.
16. Client Responsibilities
The Client is responsible for providing accurate booking information, arriving on time, obtaining any necessary permissions for locations or venues, and ensuring that members of the Client's party comply with applicable rules and laws.
17. Governing Law
These Terms will be governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where applicable law provides otherwise.
18. Changes to These Terms
Laklin Brooke Photography may update these Terms from time to time. The current version will be made available through the website or otherwise provided to Clients.
Terms contained in a signed photography agreement will control over these general website Terms where there is a conflict.
